Chris Brown (L)
HABARI DAILY I Kampala, Uganda I His position as one of the biggest R&B singers in the world has not spared Chris Brown from a criminal conviction, but the American star has avoided immediate imprisonment after being sentenced to eight months in prison, suspended for 12 months, for attacking a music producer with a glass tequila bottle at a London nightclub.
Brown, 37, received the sentence at Southwark Crown Court on Monday, October 26, 2026, after pleading guilty to affray over the February 19, 2023, attack at Tape, a private members’ club in Mayfair, central London.
His vocal coach, rapper Omololu Akinlolu, who joined the assault, was handed a four-month prison sentence, also suspended for 12 months. Both men were ordered to pay £1,500 in costs.
The sentences mean neither man will serve the prison term immediately, provided they comply with the applicable conditions and do not commit another offence during the suspension period.
The case has attracted attention because of the seriousness of the violence, Brown’s international celebrity and the legal changes that influenced the sentencing decision.
Judge Condemns Serious Violence
Sentencing the singer, Judge Tony Baumgartner said the attack involved dangerous violence in a crowded entertainment venue, putting not only the victim but also other clubgoers at risk.
“The repeated use of a glass bottle in that way, especially aimed at the head, was plainly dangerous,” the judge said, warning that the attack carried the risk of causing more serious injuries than those ultimately sustained.
The court watched three pieces of closed-circuit television footage showing the incident, which lasted between 17 and 20 seconds.
Prosecutor Heidi Stonecliffe KC told the court that Brown approached music producer Abraham ‘Abe’ Diaw on the dance floor at about 03:00 and struck him repeatedly with a heavy, square-shaped tequila bottle.
The footage showed Brown hitting Diaw four times with the bottle, including twice on the head and another blow to the shoulder. Brown had to be physically pulled away from the attack, the court heard.
Akinlolu subsequently punched Diaw in the head. According to the Crown Prosecution Service (CPS), the assault continued as the victim attempted to escape through the nightclub.
“They continued their assault whilst the victim attempted to flee through the club,” the CPS said. “The victim was kicked while he was seated defenceless on the floor.”
The judge described the incident as serious violence committed by two people in a crowded nightclub, although he noted that it had not been planned.
Why Brown Escaped Immediate Imprisonment
Despite finding that the offences warranted custodial sentences, Judge Baumgartner said changes to sentencing laws meant the prison terms had to be suspended unless exceptional circumstances justified immediate imprisonment.
The judge considered whether the seriousness of the offences, together with the need for punishment and deterrence, amounted to exceptional circumstances requiring the men to be jailed immediately. He concluded that they did not.
“These were serious offences deserving of custodial sentences, but the circumstances do not justify displacing the [new legal] requirement that those sentences be suspended,” he said.
The judge also considered Brown’s guilty plea, compliance with bail conditions and the likely impact of imprisonment on his four children. He assessed the singer’s risk of further offending as low.
However, Baumgartner made clear that Brown’s fame and financial success did not entitle him to preferential treatment.
“Your fame, commercial success and professional standing do not entitle you to special treatment—the law applies equally to everyone,” the judge said.
The decision therefore did not amount to an acquittal or an exemption from punishment. Brown received a custodial sentence, but its immediate execution was suspended under the applicable sentencing rules.
